On behalf of [COMPANY NAME], I write in support of AB 1104. The bill will reduce administrative burden and unnecessary risk for small businesses that seek to generate their own electricity.

Since January, all solar installations for commercial customers have been classified as public works projects. This includes small commercial customers like a medical office or an auto repair shop. These are clearly not the same as a school or local government campus, which are required to run bidding processes with detailed requirements and reporting obligations.

Of the different public works requirements – paying prevailing wages, submitting certified payroll records, sending notices of apprenticeship opportunities, and the customer registering as an “awarding body” – it is the last one that is completely unworkable. It is achievable for a school district that hires a consultant to run their bidding process, but it is not reasonable for a small private company that is just hiring a contractor.

AB 1104 would not weaken the prevailing wage and apprenticeship requirements. It would make them more workable. I would be on the hook for compliance. It would also remove the outrageous provision that the customer would lose access to the net billing tariff (aka NEM-3) if the contractor knowingly doesn’t follow all public works requirements. Go after contractors for that, not customers.

We strongly support this effort to treat solar customers with respect.
